Email, declining of terms of service

Before I updated to Anna, the well known trick of declining the terms of service for the email client was possible.

Now, when i create a new mailbox for gmail and yahoo, it no longer has this option. However for Hotmail it does.

Any ideas why? Is is because my phone previously accepted a certificate from Google during the mailbox creation?

I was able to do it on my E7, for setting up gmail
I used these instructions
but i did a soft reset due to another issue, we really none issue i just did not know what i was doing.
