FOTA is not only for OS9.3 or even OS9.1 sp1? Is that for real?

I have this firmware on my N80 and yes, under device manager there is a new option for Software Update which connects to internet and checks for firmware updates woohoo! (Right now obviously it says no update available coz I have latest)

i just upgraded my n80 to v4.0623.0.41 . now, my phone asks for the date and time everytime i restart my phone. furthermore, the theme always returns to the stock nokia theme. i went to a nokia service center and they thought that there is something wrong with my device, so they diagnosed it and told me that everything is okay but the new firmware version is not. any suggestion on what to do besides waiting for the newer firmware?
